Privacy Policy
Last updated: October 18, 2026
1. Who we are and what this covers
Nibs Nutrition LLC, a Michigan limited liability company ("Nibs," "we," "us"), runs the Nibs waitlist website (the "Site"). This policy explains what personal information we collect through the Site, the waitlist, and the Free Tin Promotion, how we use and share it, and the choices you have.
We never sell your personal information for money.
This policy covers the Site only. When our online store launches, it will have its own privacy policy, which will apply to anything you do there. The Site is intended only for people 18 and older who live in the United States.
2. Information we collect
Information you give us
Waitlist signup: your email address, the date and time you signed up, and your acceptance of our Terms and this policy.
Free tin claim: your full name, US shipping address, date of birth (to verify you are 18 or older), and your confirmation of the acknowledgments in the Terms.
Messages: anything you send us by email, such as questions, privacy requests, or feedback.
We do not ask for, and do not want, information about your health, medical conditions, or medications. For the free tin, we only need your yes-or-no confirmation. Please do not send health details.
Information collected automatically
When you visit the Site, our hosting provider automatically records standard technical information, such as your IP address, browser type, device type, operating system, pages viewed, the page that referred you, and the date and time of your visit. This is used to deliver the Site, keep it secure, and prevent fraud and duplicate signups.
Information from others
If we use advertising or analytics tools (see Section 5), those partners may give us aggregate or de-identified reports about how people found and used the Site.
3. How we use your information
Run the waitlist and tell you when Focus+ launches.
Run the Free Tin Promotion: rank entries by signup time, verify age and eligibility, detect duplicate or fraudulent entries, and ship tins.
Send you emails about the launch, promotions, product news, and offers. You can unsubscribe anytime.
Respond to your messages and privacy requests.
Operate, secure, and improve the Site, and prevent fraud, abuse, and spam.
Comply with the law, enforce our Terms, and protect the rights, safety, and property of Nibs, our customers, and others.
Carry out a business transfer described in Section 4.
4. How we share your information
We share personal information only as described here:
Service providers who help us run the Site and the waitlist, under contracts or terms that limit their use of your information. These include our website hosting provider, our cloud spreadsheet and email providers, and shipping carriers for free tins.
Our online store. When our store launches, we will move waitlist information to our e-commerce platform so we can tell you the store is open and honor waitlist offers. The store's privacy policy then applies.
Advertising partners, if we run ads, as described in Section 5.
Legal and safety reasons, when we believe in good faith that sharing is required by law, subpoena, or court order, or is needed to protect the rights, property, or safety of Nibs, our customers, or others, or to prevent fraud.
Business transfers. If Nibs is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its assets, your information may be transferred to the buyer or successor, who will be bound by this policy for information collected under it.
With your consent, for any other purpose we tell you about at the time.
5. Cookies, analytics, and advertising
The Site uses only the cookies and similar technologies needed to load and secure it. We may later add analytics tools (such as Vercel Web Analytics or Google Analytics) and advertising tools (such as the Meta Pixel, Google Ads tag, or TikTok Pixel) to measure visits and ad performance. We may also upload a scrambled (hashed) version of email addresses to ad platforms to show ads to people on our list or to similar audiences. We will update this policy before adding any of these.
Under some state laws, this kind of advertising use counts as "selling" or "sharing" personal information, even though no money changes hands. You can opt out at any time by emailing legal@nibsmints.com with the subject "Do Not Sell or Share," or by turning on Global Privacy Control in your browser, which we treat as a valid opt-out.
You can also block or delete cookies in your browser settings, and adjust ad preferences directly in your Meta, Google, and TikTok accounts.
6. How long we keep your information
We keep personal information only as long as we need it for the purposes in this policy:
Waitlist email and signup time: until you unsubscribe or ask us to delete it, or until 24 months pass with no purchase and no engagement, whichever comes first.
Free tin claim details (name, address, date of birth, and acknowledgments): 3 years after the promotion ends, to document eligibility and resolve disputes.
Messages and privacy requests: 3 years.
Technical and security logs: as long as our hosting provider keeps them, typically under 12 months.
We may keep information longer if the law requires it or if it is needed for an active legal claim. After an unsubscribe, we keep your email on a suppression list so we never email you again by mistake.
7. Your rights and choices
Wherever you live in the United States, you may ask us to:
Access the personal information we have about you, and get a copy in a portable format.
Correct information that is inaccurate.
Delete your information.
Opt out of any "sale" or "sharing" for targeted advertising (see Section 5).
Unsubscribe from marketing emails using the link in any email.
How to ask. Email legal@nibsmints.com from the address you signed up with, and tell us what you want. We will confirm it is you by replying to that address, and we respond within 45 days. If we need more time, we will tell you why and may take up to another 45 days. You may use an authorized agent, who must show us your signed permission. If we deny your request, you can appeal by replying to our decision, and we will answer the appeal within 60 days.
No discrimination. We will not treat you differently for using these rights. Deleting your information or unsubscribing before your tin ships does end your eligibility for the free tin, because we cannot send it without your information.
8. Security, children, and other points
Security. We use reasonable administrative and technical safeguards, such as limiting access to waitlist records to authorized Nibs accounts. No website or online storage is ever completely secure, so we cannot guarantee absolute security. If a breach affects your information, we will notify you as the law requires.
Children. The Site is not for anyone under 18, and we do not knowingly collect information from anyone under 18. If we learn we have, we will delete it. If you believe a minor has signed up, email legal@nibsmints.com.
Location. The Site is meant for US residents only. Your information is stored and processed in the United States and in other countries where our service providers operate.
Do Not Track. Browsers' older "Do Not Track" signals have no common standard, so we do not respond to them. We do honor Global Privacy Control (see Section 5).
Other sites. Links to other websites or social media are governed by those sites' own privacy policies.
9. State privacy notices
Some states, including California, require a notice of the categories of personal information collected, where it comes from, why, and who receives it. In the 12 months before the date above, and going forward:
Identifiers, such as your email address, name, and IP address. Collected from you and your device. Used to run the waitlist and promotion, send emails, and keep the Site secure. Disclosed to service providers, and to advertising partners if we use advertising tools.
Customer records, such as your shipping address. Collected from you. Used to ship free tins. Disclosed to service providers and shipping carriers.
Age information, meaning your date of birth. Collected from you. Used only to verify that you are 18 or older. Disclosed to service providers.
Internet activity, such as pages viewed, the referring page, and browser type. Collected from your device. Used to run and secure the Site, and to measure ads if we use advertising tools. Disclosed to service providers, and to advertising partners if we use advertising tools.
Inferences. We do not collect or create profiles or inferences about you.
We do not collect sensitive personal information as defined by California law, except date of birth used only for age verification, and we do not use it to infer anything about you. We do not sell personal information for money. If we use advertising tools, that use may count as "selling" or "sharing," and you may opt out as described in Section 5. We do not knowingly sell or share the information of anyone under 18.
Nevada residents may opt out of any sale of personal information by emailing legal@nibsmints.com, even though we do not sell it today.
10. Changes and contact
We may update this policy. We will post the new version with a new "Last updated" date, and if a change is material, we will email the address on the waitlist before it takes effect. The most recent version posted on the Site replaces and supersedes all earlier versions. Each change takes effect when posted, or on any later date stated in the update, and applies going forward. If we make a material change to how we use personal information we already collected, we will ask for your consent before applying that change to it.
